Real Estate Auction Terms and Conditions
The following are the terms and conditions of the auction today. Please review, and if there is anything that you do not
understand, please see the Auctioneer/R.E. Broker.
✦ All of the real estate being auctioned today is done so with a RESERVE and subject to seller and lienholder confirmation.
✦ You should be registered and have obtained a bidder’s number in order to be able to bid today. If you have not done
so, please go to the registration table and obtain your bidder number.
✦ A 5% Buyer’s Premium is being charged for all property; 5% will be added to your bid to determine the total purchase price.
✦ The high bidder (subject to seller and lienholder confirmation) on the real estate will pay a $10,000 deposit and sign the real estate sales contract immediately after the auction. The closing will be within the next 30 days at Buyers Expense.
✦ Title insurance will be available at the expense of the Purchaser. All taxes will be prorated as of the closing date, and the buyer will pay all closing costs.
✦ All property is being sold today “As Is / Where Is”. The only guarantee from the seller is a valid, good and marketable title to the property. Neither the seller nor Auctions First or Nick Clark R.E. Broker or any of its employees are giving any warranties other than the seller’s title warranty. The property is being sold subject to all easements,
covenants, conditions, zoning, and any other existing matters. Information contained, herein is deemed to be accurate but not guaranteed. Bidder should verify all information.

A Non-Refundable Bid Deposit/Down Payment of $10,000.00 is required. Failure by the winning bidder
to sign the real estate contract will result in the forfeiture of any monies paid as a bid deposit and/or down payment.

Bidders must provide prior to the auction a Cashier’s Check for $10,000.00 drawn on a US bank.
